Jammu May, 02:- Shifting of recruitment and service matters to Central Administrative Tribunal (CAT), Chandigarh that too when the whole world is untidily fighting war against COVID-19 is yet another big blow to the Jammuties in particular and the people of downgraded state of J&K is general, is a matter of serious concern said two times Law Maker and Advocate practicing in J&K High Court Mr. Ashok Kumar Sharma in a statement issued here today.
He said that the enemies of Jammu are holding hidden grip on the ruling dispensation, while sitting in the Duggar Territory and the union capital are continuous fulfilling their agenda, need a serious consideration of one and all. Unless these Jai Chands are identified and checked, the origin of Jammu as well as the erstwhile state, will have continuous threat of its very existence of this region.
By the proglomation of 29th April mid night order, the Union Government has caused distance to its slogan “Justice to the door step” and “Speedy Justice”. This one stoke of pen has hit about 25 lac educated unemployed youth who need justice in recruitment, 4.5 lac employees, 1.5 lac pensioners besides thousands of Daily Wagers, RET Teachers, SPO’s, Anganwadi Workers, CP, PDL and TDL workers etc.
Service and selection matters pertaining to local government in Himachal Pradesh, Punjab, Haryana and Chandigarh are being heard by the High Courts of Himachal Pradesh and Punjab and Haryana High Courts at Chandigarh. Even at present, only the matters pertaining to the recruitment and service causes are being heard by the CAT at Chandigarh which has only two members bench. No doubt this bench off and on visits Jammu like that of Armed Forces Tribunal but practically we find the disposal speed is so slow that they decide hardly few dozens of cases annually.
J&K High Court has large number of selection and service matters and these cases will fine more than 50% bulk, out of the total number. This High Court was trying for increase of strength of Judges which has recently been improved. These appointments of new Judges in J&K High Court hopefully was expected to deliver speedy Justice to the litigants. Moreover, the verdicts of the High Court in service and selection matters come out with quality Judgments in comparison with the Tribunals as well.
Some vested interests have already made the lawyers associations, victim of their apathy just to please big biggs having inclined to achieve unwanted personal targets and led down the Bar Association Jammu, premier public body of intellectuals which always succeeded in their struggle against injustice may it regional imbalances agitation, MBBS Darbar Move, Shri Amar Nath Land Agitation but recently such elements succeeded in stabbing back, especially the young lawyers and struggle against shifting of registration work from Judicial Offices to Executive Officers and now trying to create confusion and are misleading the people with regard to shifting of service and selection matters to Chandigarh. It is a simple travesty of Justice.
Mr. Sharma appealed the Union Government to roll back 29th April decision in general public interest ensuing restoration of trust of people of Jammu in Particular and the downgraded states of J&K in general.
