Government order creation of 8 Supernumerary Posts in Rajouri Forest department after Apex Court’s Contempt Petition Notice.

RAJOURI DECEMBER 30:— The J&K government vide its order No. 1371-JK (GAD) of 2021 dt 28/12/2021 ordered the creation of 8 supernumerary posts in Forest, Ecology & Environment Department in district Rajouri after the Contempt Petition Notice from the Apex Court.
This will complete the process of appointment of 75 Class IV employees for which the posts were advertised in 2006.
Pertinently, in 2006 vide government order No.42-GAD dt 9/1/2006, seventy-five class IV posts were allocated to the Deputy Commissioner (DC) Rajouri for recruitments through open competion in various departments.
The appointments were delayed after a round of litigation. Following directions of the Apex Court, the DC Rajouri vide order No.DCRI2021-22/Estt/IOI-111 dt 23/4/2021 finalised the selection process and issued appointment orders in respect of the candidates who had applied against these Class-IV posts advertised in 2006.
Subsequently, vide order No. DCRl2021-22/Estt/112-122 dated 26.04.2021, the panel of all the selected candidates was forwarded to the respective District Officers for issuance of formal appointment orders according to the Department-wise posts allocated.
But the Department of Forest, Ecology and Environment Rajouri didn’t allow 8 candidates to join in view of the non-availability of vacancies in the department.
Once again the appointments were delayed and the GAD received a ‘Contempt Petition Notice’ from the Hon’ble Supreme Court through DC Rajouri for non-implementation of the Order of the Supreme Court dated 03.02.2020 passed in CA 952 of 2020 titled State of Jammu and Kashmir and Others V/s Nazir Ahmad Yatoo and Others.
The case was examined and referred to the Finance Department for the creation of 8 supernumerary posts for adjusting these leftover appointed candidates in view of the peculiar circumstances of the case and keeping in view the orders of the Hon’ble Supreme Court.
“Now therefore, in compliance to the orders of the Hon’ble Supreme Court and in light of the concurrence of the Finance Department conveyed vide U.O. No. FD-Code/294/2021-03-1332 Dated: 10.12.2021, sanction is hereby accorded to the creation of 08 (eight) Class-IV supernumerary posts in Forest, Ecology and Environment Department in District cadre Rajouri for appointment of the above said petitioners, till the posts become available in Forest, Ecology and Environment Department in District Rajouri subject to the condition that the said posts will get abolished once regular vacancies are available in District Rajouri, Forest department” reads the government order.
