    Kargil April 07:–A spring festival to celebrate the sowing season as well as to impart education among the voters, Aryan Voter Festival was organised in District Kargil. Spring, the sowing season, has a great importance in rural areas especially in Aryan tradition. The programme began with a gathering at the Changra, where villagers were imparted voters education/awareness in the wake of upcoming parliamentary elections. Speaking on the occasion DEO Kargil urged the audience to enthusiastically participate in the overall elections processes and stressed on ethical voting in the upcoming Lok Sabha election 2019. Adorned in their cultural attires, the residents of Aryan Valley performed cultural dance on the occasion besides keeping some of their demands before the DC/DEO.

    WARDHA: Accusing Prime Minister Narendra Modi of hogging credit for the Balakot air strike, Congress chief Rahul Gandhi Friday dared him to hold a rifle “for just five minutes” or travel alone in a bus in Jammu and Kashmir.

    Addressing a poll rally here, Gandhi said the only thing “chowkidar” Modi did was to ensure “his boss” industrialist Anil Ambani got the Rafale fighter jet contract.

    The Congress believes in uniting people while theBJP divides people, he said.“It was the Air Force personnel who displayed real valour by carrying out the air strike in Pakistan,” he said.

    The Indian Air Force carried out strikes on terrorist camps in Balakot in Pakistan after the Pulwama terror attack in which 40 CRPF men were killed.“(But) the prime minister says he did it. You (Modi) did it? Could you please show (us) how to hold a rifle? Hold a rifle, the way our CRPF men do, for just five minutes.“Or travel in a bus alone in Jammu and Kashmir. Show us. You did the air strike? What did you do? The Air Force carried out the bombing,” Gandhi said.“It is NarendraModi who did it (the air strike). He did it sitting on Race Course Road (now LokKalyanMarg, where the prime minister’s official residence is located),” Gandhi said.

    The Congress leader also said that Modi had promised to create two crore jobs a year and deposit Rs 15 lakh in each person’s bank accountin 2014.

    Referring to Modi’s rally in Wardha on Monday, Gandhi said, “A few days ago, he was here. Did he talk about employment? Did he apologise for not keeping the promises?”Demonetisation and the Goods and Services Tax (GST) as introduced by the Modi government hurtthe economy, Gandhi said.“Did he apologise for the closure of factories hereafter demonetisation and GST implementation?” asked the Congress chief.

    Unlike the BJP, the Congress does not want “two Indias”, one of the rich and the other of poor farmers and labourers, he said.“We want one India. There should be justice for everyone, farmers, the youth, small traders and others. There should be a place for big industrialists too,” he added. (PTI)

  • Court directs registration of FIR against GMC Principal

     

    JAMMU: Chief Judicial Magistrate (CJM) Jammu Ashwani Sharma today directed SSP Jammu to register FIR against Dr Sunanda Raina, In-Charge Principal Government Medical College Jammu and Dr Vishal Tondon, Associate Professor Department of Pharmacology.
    Advocates Vivek Sharma and Amit Kumar appearing for the complainant submitted before the CJM that the complainant had applied for the post of Associate Professor (on academic arrangement basis) in Department of P&SM GMC, Jammu on 10.04.2017 in response to the advertisement issued by the GMC Jammu, adding she was the sole candidate who had applied for the post of Associate Professor against two vacancies. However, the result of the applicant was not declared deliberately in order to oust her and to adjust blue eyed person.
    Though applicant was interviewed by the committee comprising of four members yet the result was not declared for some extraneous reasons. The husband of the applicant also applied before the Public Information Officer seeking information but the same was also denied. Thereafter, the husband of the applicant filed 1st appeal before the Principal GMC, Jammu being 1st Appellate Authority under the RTI Act on 10.01.2018, which was disposed off against the satisfaction of the appellant leading to filing of 2nd appeal before the State Information Commission on 27.02.2018.
    After going through the order passed in the 2nd appeal under J&K RTI Act, 2009, the court observed, “in the award sheet the expert Dr V K Bhan has declared Dr Bhavna Sahni as selected with 08 marks out of 10”, adding “there is no dispute amongst any of the members of the interview panel regarding the eligibility of Dr Bhavna Sahni for the post of Associate Profession (on academic arrangement basis) as her eligibility was confirmed by the then Registrar Dr Vishal Tandon to the Principal GMC, Jammu in front of all the penal members before the interview process started”.
    “It has come to the fore that applicant was unanimously selected by the interview panel as she was only candidate who had appeared against the two vacant posts of Associate Professors advertised by the GMC, Jammu”, the court further observed, adding “copy of the award roll submitted before the Commission clearly shows tampering with 07 marks awarded by Dr Dinesh Kumar, one of the panelists after conducting interview of the applicant”.
    “It has further come to the fore that there was no question of putting NE in the remarks column when the complainant was unanimously selected. As per the version of Dr Dinesh Kumar letters NE in remarks column have been illegally inserted by someone else for the reasons best known to him”, the court said.
    Ex-facie if the allegations levelled in the application and the annexures annexed with the application are to be taken into consideration in their entirety at their face value commission of cognizable offence under Section 120-B read with Section 468 & 466 RPC and other relevant sections pertaining to forgery with intent to cheat are disclosed against the accused persons, the court further said.
    “The applicant has also approached the SSP Crime Branch, Jammu for lodging the FIR and investigation, but her request has not been considered. The matter being of a serious nature, as such, I deem it expedient to direct SSP Jammu to lodge the FIR against the accused persons, investigate the matter and file compliance report”, Chief Judicial Magistrate said.

    District Election Officer Rajouri launches ‘Sahulat’ mobile app to reach out to voters above 90 years of age * The app is based on theme of Accessible Elections of the ECI*

    Rajouri, April, 04: The District Election Officer, Rajouri Mohammad Aijaz Asad today launched an android based app called “sahulat” for the old age voters.

    The district administration Rajouri has developed a mobile app Sahulat to particularly reach out to the voters who are 90 years old or more. DEO said working on the theme of Accessible elections and to facilitate the old age voters a special initiative has been taken to encourage the old age voters to participate in the elections.

    The DEO further said that voters will have to provide input with few details, like name and age, distance of polling station,EPIC number , Assembly Constituency and other details. The voters can request for the facilities like the provision of the wheelchair, vehicle for transportation and any helper who will assist them during casting of votes. The app is designed to aid the old age voters’ only. This App is free of cost and the citizen can download it from the Google Play Store. There are two versions of this app one for the citizen where they can fill their requirements and other for the officer who can access and provide data regarding necessary arrangements.

    “This app requires an Android smartphone, equipped with good internet connection. The operating system should be Android jellybean and above”,officer of NIC said.

    He said the App has simple and user friendly interface and much focus has given on it. Morover the login operation has been kept simple so that everyone can access it.

    Much care has been taken into account while developing the App keeping almost all the factors like age , literacy rate etc.

    The App is an initiative of District Election Office Rajouri and developed by National Informatics Centre Rajouri .

    Government Hands over investigation of major JKPCC Scams to Crime Branch of J&K Police; FIR to be lodged*

    The Government today decided to hand over the investigation of major scams in Jammu & Kashmir Projects Construction Corp (JKPCC) to the Crime branch of JK Police. This is a major step towards eradication of corruption in the organisation, stopping and eliminating backdoor appointments and bringing in a culture of transparency, probity and efficiency in the organisation.

    After receiving numerous complaints from many quarters about the functioning of JKPCC, particularly relating to corruption in civil contracts, illegality in appointments at multiple levels including at very senior positions, and excessive cost and time overruns, the government appointed a Fact Finding Committee to look into all these complaints. The Fact Finding Committee was chaired by the Principal Secretary (Planning), and had the Divisional Commissioner (Jammu), Commissioner/ secretary (revenue) and MD, JKPCC as members.

    The mandate of the Committee was to look into:

    i) Manner of awarding contracts to contractors often on a nomination basis without following transparent tendering procedures.

    ii) Diverting funds from one project to another leading to a large number of incomplete projects whose funds have been received but diverted elsewhere.

    iii) Irregularities in appointments at various levels, including that of the Managing Director.

    iv) Inefficiency in functioning and huge time and cost overruns in project implementation.

    v) Reasons for estimates for construction being much higher than those of PWD.

    The Fact Finding Committee submitted a voluminous report bringing out in detail large irregularities in the operation of JKPCC. The Committee also gave recommendations on improving the organisation.

    There are many elements in the findings and observations in the report which are quite alarming and a cause of serious concern. For an organisation which is over 50 years old, its operations seem to be riddled with ad-hoc functioning, absence of rules and a lack of systematic procedures. These have given rise to irregularities, which is a serious concern, and necessary measures for correcting these have to be taken to bring some order in the Corporation for its own health and long term welfare.

    Keeping in view the seriousness of the matter and the findings of the Committee, the Government has decided on the following:

    a) Execution of Construction Works: The report clearly brings out that construction works have been executed by giving contracts on nomination basis, whereas JKPCC should have executed works in a departmental mode. This is a clear violation of a Government Order of November, 2015 which was adopted by the Board of Directors in February, 2016. Irregular procedures in violation of government orders and BoD laid down SoPs are also noticed in engagement of consultants and nomination of piece workers. The Government has decided to hand over the investigation of all works executed or contracted out by the JKPCC after the issuance of the GovernmentOrder of November, 2015 to the Crime Branchof Police (Srinagar) to identify any irregularities in award of contracts in violation of prescribed SOP / procedures and take necessary action as per law. Based on the enquiry of the Crime Branch, further action against individuals will be taken.

    b) Irregularity in appointments including of MD: For an Organization which is in existence for the last 50 years, it has no Recruitment Rules. It is not clear whether there was adequate funding for this or whether this was done with proper authorisation/ competence. Further, the appointment of Mr. Vikar Mustafa Shonthu as Managing Director seems to have been done in clear violation of Government instructions and the Articles of Association of the Company. The appointment of the Chairman, any Director or the Managing Director is to be done by the Government, viz, either by the Cabinet or the Chief Minister in co-ordination. It appears that this appointment was done by the Chairman (who was the then Minister), who was not competent to do so. The appouintment was ab initio illegal.The Government has decided that the irregularity in the appointment of Mr. Vikar Mustafa Shonthu as Managing Director be referred to the Crime Branch of Police, Srinagar immediately for lodging an FIR and taking further action. Crime Branch would examine the role of the Chairman,the Board of Directors, the Administrative Secretary and the Company Secretary in this matter and take action as per law.

    c) The Fact Finding Committee will also look into all appointments made by JKPCC and ensure that all irregular appointments are terminated and action taken against those responsible. This will be done in three months, by 30.6.2019. Principal Secretary (Planning), as Chairman of the Committee shall oversee this entire process.

    d) Improving Control over JKPCC: In order to ensure that there is adequate oversight over the affairs of the corporation, a number of administrative steps will be taken including all powers of appointment to be removed from the Managing Director,the Administrative Secretary being made Vice Chairman of the Board, and all proposals made by the MD to the Chairman or to the Board to be routed through the Vice Chairman necessarily.

    e) Excessively High Estimates of JKPCC: JKPCC’s estimates should be either based on actual costs plus an overhead or based on PWDs Schedule of Rates which have an inbuilt overhead. The cost estimation procedure of JKPCC will be reformed through a Committee to be proposed by Administrative Secretary, PWD.

    f) Cost Overruns and Diversion of funds: The Committee reveals shocking details regarding diversion of funds by JKPCC from one project to another. This indicates poor control systems and absence of proper accounting procedures. The Committee also finds that there are large cost and time over-runs in projects. This is an indication of poor project management skills and weak controls.Government is taking steps to improve the controls and project management systems in JKPCC۔

    Rajouri, Apri,02::–The 2nd phase of randomization of polling staff (P0, P1, P2, P3) for Lok Sabha Elections was done here today in presence of General Observers, Subey Singh Yadav, and Andra Vamsi, and representatives of political parties. District Election Officer Rajouri chaired the randomisation session.

    While highlighting the importance of randomization, DEO said that the process is to ensure free and fair polls with no human intervention as the randomization is being done by dedicated software for the purpose.

    DEO also briefed the political representatives about the randomization process and assured them that all necessary arrangements have been put in place to ensure free and fair polls. He also highlighted that all the AROs as well as polling staff were apprised of their responsibilities for the smooth and fair conduct of general elections and were impressed upon to strictly follow the guidelines of the Election Commission of India and work in coordination for free and fair conduct of elections through series of training conducted exclusively to train them about the election-related issues.

    Regarding EVM he added that 20% of the total EVMs allocated to each polling station will be kept a reserve to meet any contingency during the polling day.

    The general observer for the Rajouri-Darhal constituency advised the election authorities to decentralize the distribution of EVMs. He said the reserved polling parties should be stationed at the nearest tehsil or naib tehsil headquarter so that during any contingency there would no time lapse.

    They also held a threadbare discussion with the District Election Officer reading arrangement to be made on the dispatch day and during the collection of EVMs at the strong rooms.

    DEO assured the general observers and the representative of the political parties that district administration is committed to conducting free and fair election with the maximum turn out.
