Public Servant vs. Public Representative: MLA Doda vs. DC Doda

JAMMU SEPTEMBER 10:-The debate over the use of the Public Safety Act (PSA) against AAP MLA Mehraj Malik has triggered a larger discussion on the difference between a public servant and a public representative, and the constitutional implications of detaining an elected lawmaker.
A public servant – such as a Deputy Commissioner (DC), police officer, or bureaucrat – is an employee of the government. Their accountability lies within the executive framework, governed by service rules, superiors, and the government of the day. Misconduct is dealt with through suspension, disciplinary proceedings, or trial under ordinary criminal law.
A public representative, like an MLA or MP, draws legitimacy directly from the people’s vote. Their accountability is threefold: political (to voters), constitutional (to the legislature), and legal (to the courts). Unlike bureaucrats, they are part of the democratic structure itself.
The Jammu and Kashmir Public Safety Act (PSA) empowers authorities to detain individuals without trial for up to two years in cases of security threats or one year in cases of public order. While intended for grave situations such as terrorism or smuggling, it has often been criticized for vague and arbitrary use.
Mehraj Malik, an elected MLA from Doda, is the first legislator to be detained under PSA. Legal experts note that the Act does not exempt MLAs, but applying it against a legislator bypasses the normal democratic and judicial processes. “If an MLA has committed an offence, prosecution under the IPC or CrPC is the lawful path, not preventive detention,” a senior lawyer observed.
Political leaders including Omar Abdullah, Aga Ruhullah, and Asaduddin Owaisi have condemned the detention, calling it an attack on democracy and a dangerous precedent. Critics argue that it undermines the people’s mandate and weakens legislative institutions by allowing the executive to silence elected voices.
Courts have consistently held that preventive detention should be used sparingly and never as a substitute for trial. Unless the government can prove that Malik posed an imminent and grave threat to national security, the use of PSA against him remains constitutionally and democratically questionable.
In contrast, a public servant like the DC Doda can be suspended or disciplined under service rules for any misconduct. But a public representative’s accountability lies in the courts and, ultimately, with the people. Applying preventive detention against an MLA, experts warn, risks eroding public trust in democracy itself.
Meanwhile, Malik’s detention has sparked mass protests by his supporters, voters, and followers across Jammu and Kashmir, with demonstrators demanding the immediate revocation of PSA and his release.

کہا جا رہا ہے کہ زمین کی گہرائیوں میں، تقریباً 200 کلومیٹر نیچے، ایک پراسرار اور ناقابلِ وضاحت تبدیلی وقوع پذیر ہو رہی ہے۔ دس سال پہلے زمین کے نیچے موجود لاوے کا اوسط حجم صرف 130 کلومیٹر تک محدود تھا۔ لیکن آج، محض ایک دہائی بعد، یہ لاوا خطرناک حد تک اوپر کی جانب سرک چکا ہے اور اب یہ 160 کلومیٹر کی سطح تک آ پہنچا ہے۔ یہ محض ایک عدد نہیں، بلکہ ایک ایسا الارم ہے جو زمین کے اندرونی نظام میں کسی بڑی تبدیلی کی خبر دے رہا ہے۔
اس کی وجہ سے زمین کی پرتیں (plate tectonics) غیر متوقع حد تک حرکت کر رہی ہیں، جس کے اثرات زلزلوں اور سمندری طوفانوں کی صورت میں ہمارے سامنے آ رہے ہیں اور یہ صرف آغاز ہے۔
مگر اصل خوفناک بات ابھی باقی ہے۔
رپورٹ کے مطابق، زمین کے مرکز میں موجود لاوا اب اپنی گردش کی سمت (rotation direction) بدل رہا ہے۔ یہ وہ تبدیلی ہے جس نے سائنس دانوں کو بھی خاموش کر دیا ہے، کیونکہ اس کے اثرات زمین کے نارتھ اور ساؤتھ پولز کو آہستہ آہستہ اُلٹ رہے ہیں۔ قطبین کی یہ تبدیلی معمولی بات نہیں، یہ وہ علامت ہے جو زمین کے مقناطیسی نظام کے مکمل طور پر اُلٹنے کی طرف اشارہ کر رہی ہے۔
اور اگر یہ سب کچھ اسی رفتار سے جاری رہا… تو 2030 تک وہ لمحہ آ سکتا ہے جب لاوا زمین کی سطح سے صرف 10 کلومیٹر نیچے رہ جائے گا یعنی 190 کلومیٹر کا فاصلہ طے کر لے گا۔ اُس کے بعد زمین کی درجہ حرارت 65 ڈگری سیلسیس تک بڑھ سکتا ہے۔ سوچیں… انسان، جانور، پودے سب کچھ آگ کی لپیٹ میں جا سکتا ہے۔
سائنس خاموش ہے، ماہرین بے بس، اور انسانیت ایک ایسے خطرے کے دہانے پر کھڑی ہے جس کا نہ کوئی حل ہے، نہ کوئی یقین۔
کیا ہم نے زمین کے ساتھ کچھ ایسا کر دیا ہے جو اب پلٹ کر ہمارا انجام لکھنے آ رہا ہے؟
یہ صرف وقت ہی بتائے گا… یا شاید، وقت بہت کم رہ گیا ہے۔ -

Budhal Spiker’s Cup Concludes with Thrilling Final Match

BUDHAL SEPTEMBER 09:-The concluded final match of the Budhal Spiker’s Cup Volleyball Tournament was held today at Budhal, attracting a large gathering of sports enthusiasts and local residents. The much-anticipated grand finale featured a thrilling contest between Team Rajouri and Team Budhal, both of whom had performed exceptionally throughout the tournament.
In a spirited and high-energy encounter, Team Rajouri clinched the title with a 3–1 victory over Team Budhal. Players on both sides showcased remarkable skill, determination, and team spirit, earning admiration from the cheering crowd.
The final event was graced by Mr. Khadam Hussain Shah, Block Development Officer (BDO) Budhal, as the Chief Guest, and the Headmaster of Girls High School Budhal as the Guest of Honour.
The winners, Team Rajouri, were awarded the Championship Trophy along with a cash prize of ₹10,000, while the runners-up, Team Budhal, received ₹5,000 in recognition of their valiant effort.
The tournament was proudly sponsored by Crescent Welfare Trust and efficiently managed by Mr. Tasadak Bhat (Chief Manager), with the support of Mr. Yasir Latief and Mr. Altaf Dar, whose dedicated efforts ensured a smooth and successful event.
Speaking on the occasion, BDO Budhal praised the organizers and sponsors for promoting sports at the grassroots level. He highlighted the importance of such events in channelizing youth energy constructively and nurturing a spirit of unity and sportsmanship. Voice of the People Cannot Be Imprisoned’: Said ASP Leader Yaqoob Dunoo on MLA Mehraj Malik’s Detention

SRINAGAR SEPTEMBER 09:-The Ambedkar Samaj Party (ASP) General Secretary, Mohammad Yaqoob Dunoo, has strongly condemned the detention of MLA Doda, Mehraj Malik, under the Public Safety Act (PSA), terming it an attack on democracy and an attempt to silence the voice of the people.
In a statement issued here, Dunoo said the arrest of Malik is not merely a legal move but a direct strike at the hopes of people who trusted him to be their voice. “By silencing one, countless others are left unheard. What Jammu & Kashmir needs is dialogue and respect, not fear and repression,” he remarked.
He further pointed out that the arrest has sparked protests across Malik’s constituency. Ironically, Dunoo added, the District Magistrate’s own order has disturbed peace and stability in the area. “Now, the question arises, who will hold the DM accountable for disturbing peace and posing a threat to society?” he asked.
Expressing strong resentment, Dunoo said, “I strongly condemn the booking of MLA Doda, Mr. Mehraj Malik, under the PSA. His only fault was standing with the people — the voiceless, the helpless, the unheard. He spoke truth to power, raised genuine grievances, and worked tirelessly to bring relief to those in need.”
At the same time, Dunoo also expressed disapproval of the language used by Malik against the Deputy Commissioner (DC) Doda. He stated that while dissent and criticism are part of democracy, the language employed must always remain respectful and dignified. “We may disagree with authorities and question their decisions, but resorting to harsh or derogatory language only weakens the strength of one’s argument and sets a wrong precedent. Leaders must set an example in conduct, ensuring that criticism remains constructive and within democratic bounds,” Dunoo emphasized.
He stressed that punishing a public representative for serving the public is an attack on democracy itself. “Silencing one voice will not silence the pain of thousands who suffer in silence every day,” Dunoo said.
The Ambedkar Samaj Party has demanded the immediate release of Mehraj Malik and urged the authorities to uphold the values of justice, dignity, and democracy. “The voice of the people cannot be imprisoned,” Dunoo concluded.

Reaffirming the Omar Abdullah-led Government’s commitment to safeguarding vulnerable communities, Rana said disaster response will be strengthened through sustainable, people-first policies focused on safety, stability, and environmental resilience.

SRINAGAR SEPTEMBER 09:-The Jammu & Kashmir Nationalist People’s Front (JKNPF) strongly condemns the detention of elected MLA Mr. Mehraj Malik under the Public Safety Act (PSA). This is a direct attack on democracy and the constitutional rights of the people of Jammu & Kashmir.
The misuse of draconian laws such as PSA against public representatives and innocent civilians reflects an attempt to silence the voice of the people. It is deeply unfortunate that instead of addressing the genuine concerns of citizens, governments—both past and present—have consistently resorted to suppressing democratic voices through arbitrary detentions.
In a press note JKNPF demand the immediate release of Mehraj Malik and all others unjustly detained under PSA. Democracy cannot thrive under an atmosphere of fear and repression. The government must stop misusing the law against its opponents and respect the mandate of the people.
JKNPF will continue its struggle for justice, democracy, and the rights of the people of Jammu & Kashmir.

BUDHAL-RAJOURI SEPT 09:-A massive peaceful protest was held today in Budhal, District of Rajouri, against the illegal arrest and detention of MLA Doda Mehraj Malik under Public Safety Act (PSA)
The Protest Organized by local residents, the demonstration began at 11:00 AM and was conducted in a lawful and non-violent manner, asserting the people’s constitutional right to peaceful assembly and free expression.
The protest was led by senior political figures including Mohammad Farooq Inqlabi (Senior Leader, Jammu & Kashmir Peoples Democratic Party – PDP) and Waqar Lone (Senior Leader, Jammu & Kashmir National Conference – NC). Prominent local leaders and speakers including Mohd Zaid Sagar, Sajjad Owaisi, Shakil Thaker, Manzoor Malik, and Rayaz Naik — also addressed the gathering, strongly condemning the use of PSA against an elected representative and calling it a gross misuse of power and a direct assault on democracy in Jammu & Kashmir.
Following the protest, the leaders submitted a formal memorandum to Tehsildar Kotranka, who was present on the spot, demanding the immediate revocation of the PSA imposed on Mr. Mehraj Malik. The memorandum, addressed to the Hon’ble Home Minister of India, called for a fair and transparent review of Mr. Malik’s detention, protection of democratic rights, and an end to the misuse of laws like the PSA against dissenting or elected voices.
Protesters further warned that if the PSA is not revoked promptly, they will intensify their movement and march towards Raj Bhawan for a ‘gehraav’ (encirclement protest) to demand justice and democratic accountability. The people of Budhal have urged the central government to take immediate action to restore constitutional values and democratic faith in the region.

In his X handle Mehdi argued that if an elected representative errs, he must be held accountable through the due process of law rather than preventive detention. “That is how accountability works in a democracy,” he said.
Highlighting the misuse of PSA in Jammu and Kashmir, Mehdi said the law, originally intended for exceptional cases of grave security threats, has repeatedly been used on vague and arbitrary grounds. He asserted that it has effectively become a tool to silence dissenting voices instead of safeguarding public security.
“The misuse of PSA erodes public trust in institutions and reduces a legal safeguard into an instrument of suppression,” the MP added.
While condemning MLA Mehraj Malik’s use of abusive language, Mehdi maintained that invoking PSA in this case amounts not to justice but to repression.
The statement underscores growing concerns about the erosion of democratic accountability and the continued misuse of PSA in Jammu & Kashmir.
