Subject: Key Expectations from the Final Form of the Bill for Rehabilitation and Justice of Displaced Kashmiri Pandits

    SRINAGAR AUGUST 05::::

    Respected Sir/Madam,

While we deeply welcome and support the initiative of Shri Vivek Tankha Ji for introducing the Bill in Parliament concerning the rehabilitation and constitutional justice for the displaced Kashmiri Pandit community, we wish to humbly place before you our key expectations from the final and complete form of this Bill, in addition to its passage in toto.

These expectations are rooted in historical truth, constitutional fairness, and the long-denied justice that our community has waited for over the past 36 years:

1.Constitutional Recognition of the genocide and mass exodus of the Kashmiri Pandit community, along with legal redress and national commemoration of the tragedy.

2.Consolidated and Secured Resettlement of the displaced KP community at a single, demographically secure location in the Kashmir Valley, ensuring dignity, identity, and non-fragmentation.
Importantly, in the event the Union Territory of Jammu and Kashmir is granted full statehood in the future, this proposed resettlement area must retain a special Union Territory (UT) status, directly governed by the Centre. This is essential to guarantee constitutional protection, safety, and administrative autonomy for the resettled KP community.

3.Comprehensive Compensation for lost residential homes, properties, land, shops, business establishments, and institutions assessed at current market value.

4.Grant of “Indigenous Status” to the displaced KP community, formally affirming our permanent and ancient civilizational connection to Kashmir.

5.A Special Employment Package in Central Government departments and PSUs with appropriate age relaxation for displaced Kashmiri Pandits.

6.Fool-proof security arrangements, constitutional safeguards, and legal assurances to ensure that the past atrocities and injustices never recur.

7.Legal and physical protection of temples, shrines, and heritage sites belonging to the KP community, many of which have faced systematic damage, encroachment, or neglect.

8.Adequate legislative and institutional representation for displaced Kashmiri Pandits to ensure our active participation in decisions affecting J&K and national policy.

9.Formation of an Independent Commission to monitor, supervise, and ensure the timely implementation of the entire rehabilitation plan.

10.Establishment of permanent dialogue mechanisms between the government and legitimate representatives of the displaced KP community to ensure transparency and accountability.

, We humbly urge to this august Parliament not to allow this long-overdue redressal to be reduced to tokenism or symbolic relief. Our demand is for justice with dignity, not sympathy wrapped in compromise.

Let no false narrative be allowed to take root that the Kashmiri Pandit community has opposed this Bill. On the contrary, we strongly seek its immediate debate, necessary refinement, and final passage with urgency and national consensus.

We appeal to each one of you to rise as custodians of the Constitution and conscience-keepers of Indian democracy. Let this Parliament stand above partisan lines to deliver historic justice to a community that has suffered in silence for over three decades.

Let this be a defining moment in India’s democratic and civilizational journey where justice for Kashmiri Pandits is not seen as a political concession, but as a moral, constitutional, and national imperative.

With deep hope and collective faith in your wisdom and commitment,

    Your,s Sincerely,
    [Kundan Kashmiri]
