    RAJOURI MARCH 26:– In a major development of Border Road Infrastructure, Border Roads Organisation (BRO) has on Tuesday connected the strategic Nimmu-Padam-Darcha road in Ladakh.
    This strategically important 298-km road will connect Manali in Himachal to Leh in UT of Ladakh through Darcha and Nimmu on Kargil – Leh Highway.
    The road is now the third axis apart from Manali-Leh and Srinagar-Leh which connects Ladakh to the hinterland.
    “The Nimmu-Padam-Darcha road derives its strategic importance from the fact that it is not only shorter vis-a-vis the other two axes, but crosses only one pass; Shinkun La (16,558 feet) on which tunnel work is about to commence by the BRO” said BRO officials.
    “This will result in the road having all weather connectivity to the Ladakh region. The connectivity will strengthen the defence preparedness and provide a boost to the economic development in the Zanskar valley,” officials added.
    Director General Border Roads, Lt Gen Raghu Srinivasan said that in January, when the River Zansakar was frozen, the equipment and personnel were mobilised and the work of establishing the connectivity was completed.
    He exuded confidence that the work on black topping the road will start soon.
    “With construction of Shinkun La tunnel commencing, the third all weather axis to Ladakh will be established,” said Lt Gen Raghu Srinivasan.

    RAJOURI MARCH 26:–A mysterious blast that took place in a Gurdwara Bhai Mahant Sahib situated near Raja Sukhdev District Hospital in Poonch city  late evening hours has created tension in the area.

    After getting information about the mysterious explosion SSP Yougal Manhas, and Deputy Commissioner Poonch, Yasin M Choudhary visited the spot to assess the situation.

    As per reports the sound of the explosion was heard far & wide however, there are no reports of any causality or injury to anyone.
    After the mysterious blast, forensic science experts visited the spot & found collecting samples from the spot.

    It was not immediately known whether it was a grenade blast or a low intensity explosion and who is behind this blast.
    Police, security agencies, and security forces have started further investigation.

    SSP Poonch, Yougal Manhas said that the police have received information of a suspected small intensity explosion like sound heard from an area near Poonch Hospital.Necessary investigation into the matter has been set into motion to ascertain the exact nature of the material which apparently looks like a handmade crude substance.

    RAJOURI, MARCH 26: –District Systematic Voters’ Education and Electoral Participation (SVEEP) team Rajouri in collaboration with NCC Unit and NSS club today imparted training to NCC Cadets and NSS volunteers at Government Degree College here to encourage them to extend help and support to frail and elderly to cast votes in the upcoming election of Lok Sabha 2024.

    The event was supervised by Prof. Iqbal Raina (DNO), Dr. Khalid Reyaz, Prof. Ajaz Nazir and Tanweer Ahmed Chowdhury.

    The training was imparted to the participants by Prof Khaleeq Ahmed Qazi, NSS program Officer and Major Tanveer Ahmed Chowdhary.

    Speaking on the occasion, Prof Mohammad Iqbal Raina, Nodal Officer SVEEP, said that these collaborative efforts of SVEEP team, NSS Cadets NSS volunteers would not only increase electoral awareness but also garner a strong commitment to maximize the voting percentage in district Rajouri in upcoming election.

    NEW DELHI MARCH 26:–Courts should not grant ex-parte injunctions against publication of a news article barring in exceptional cases as it may have severe ramifications for the right to freedom of speech of the author and the public’s right to know, the Supreme Court has said.

    Setting aside a trial court’s order directing international media group Bloomberg to take down an allegedly defamatory news article against Zee Entertainment, the top court said injunctions against the publication of material should be granted only after a full fledged trial.

    “The grant of a pre-trial injunction against the publication of an article may have severe ramifications on the right to freedom of speech of the author and the public’s right to know,” a three-judge bench headed by Chief Justice D Y Chandrachud said.

    The bench, also comprising Justices Justices J B Pardiwala and Manoj Misra, said an injunction, particularly ex-parte, should not be granted without establishing that the content sought to be restricted is “malicious” or “palpably false”.

    “Granting interim injunctions, before the trial commences, in a cavalier manner results in the stifling of public debate….In other words, courts should not grant ex-parte injunctions except in exceptional cases where the defence advanced by the respondent would undoubtedly fail at trial,” the bench said.

    The SC said grant of an interim injunction, before the trial commences, often acts as a “death sentence” to the material sought to be published well before the allegations have been proven.
    “While granting ad-interim injunctions in defamation suits, the potential of using prolonged litigation to prevent free speech and public participation must also be kept in mind by courts,” it said.

    The top court was hearing a plea filed by Bloomberg against the March 14 order of the Delhi High Court, which dismissed its appeal against the trail court order.

    The apex court said the error committed by the trial judge had been perpetuated by the high court and the order of the trial judge does not discuss the prima facie strength of the plaintiff’s case, nor does it deal with the balance of convenience or the irreparable hardship that is caused.

    The trial judge needed to have analysed why such an ex parte injunction was essential, after setting out the factual basis and the contentions of the respondent made before the trial judge, it said.
    This being a case of an injunction granted in defamation proceedings against a media platform, the impact of the injunction on the constitutionally protected right of free speech further warranted intervention, the bench added.

    “The error committed by the trial judge had been perpetuated by the high court. Merely recording that a prima-facie case exists for a grant of injunction, the balance of convenience lies in Zee’s favour and that an irreparable injury would be caused would not amount to application of mind in the case,” the bench, also comprising Justices J B Pardiwala and Manoj Misra, said while granting liberty to Zee to approach the trial court afresh with its prayer seeking injunction.

    The apex court clarified that the above segment of the judgment and order may not be construed as a comment on the merits of the present case and the purpose of the above segment is to provide the broad parameters to be kept in mind while hearing the application for an interim injunction.

    Reacting on the apex court order, Bloomberg News spokesperson had said, “We are very encouraged by today’s decision from the Supreme Court of India, and we continue to stand by this story.”

    Justice Shalinder Kaur of the high court had said there was no ground to interfere with the ex-parte interim order passed by the Additional District Judge (ADJ) on the lawsuit by Zee Entertainment Enterprises Limited over the article published on February 21, and ordered Bloomberg to comply with the direction in three days.

    On March 1, the ADJ had directed Bloomberg to take down the allegedly defamatory article within a week, saying Zee had established a “prima facie case for passing ad-interim ex-parte orders of injunction”.

    The ADJ had said the balance of convenience is in Zee’s favour and irreparable loss and injury might be caused to the company if the injunction was not granted.

    The appellant contended before the High Court that the lawsuit was intended to intimidate and silence their right to free and fair speech.

    It was also claimed that the ADJ did not give the portal an opportunity to place before it several other articles published prior in time and was denied a right to establish their case. (AGENCIES)

    SRINAGAR/LEH MARCH 26:–Climate activist Sonam Wangchuk, who is leading a hunger strike here to demand statehood for Ladakh and its inclusion in the Sixth Schedule of the Constitution, on Tuesday made a fresh appeal to Prime Minister Narendra Modi to fulfil promises made to the people.

    In video messages shared on X, a frail-looking Wangchuk, whose ‘climate fast’ entered the 21st day on Tuesday, called on the people of Ladakh to use their franchise “very carefully” this time in the interest of the nation.

    A renowned education reformist, Wangchuk has been on ‘climate fast’ in sub-zero temperatures since March 6, a day after talks between joint representatives of Leh-based Apex Body and Kargil Democratic Alliance (KDA), which are jointly spearheading the agitation to demand statehood for Ladakh and its inclusion in the Sixth Schedule, and the central government hit a deadlock.

    The Sixth Schedule contains provisions related to the administration of tribal areas in Assam, Meghalaya, Tripura and Mizoram through autonomous district councils.

    The ‘climate fast’ is likely to end later in the day as Leh-based Apex Body and KDA will announce the future course of action on Wednesday.

    Reminding the prime minister of the promises made by the BJP in its election manifestoes, Wangchuk said Modi is a devotee of Lord Ram and should follow his teaching of ‘pran jaye par vachan na jaye’ (one may lose their life, but must not break their promise).

    “While India is the mother of democracy, we citizens have a very special power. We are the kingmakers, we can compel a government to change their ways or change the government if that doesn’t work. Let us remember to use our ballot power very carefully this time in the interest of the nation,” said Wangchuk, whose life inspired Aamir Khan’s character Rancho in Bollywood blockbuster “3 Idiots”.

    Lok Sabha elections will be held in seven phases from April 19 to June 1. Ladakh will go to polls in the fifth phase on May 20.

    Over the past 20 days, Wangchuk said, around 60,000 of Ladakh’s 3 lakh residents have participated in the hunger strike demonstrating their pain but “no word came from this government”.

    “We are trying to remind and awaken the consciousness of our Prime Minister Modi and Home Minister Amit Shah to safeguard the fragile ecosystem of Himalayan mountains in Ladakh and the unique indigenous tribal cultures that thrive here.

    “We do not think of Modi and Amit (Shah) as just politicians, we would rather like to think of them as statesmen and for that they will have to show some character and some farsightedness,” the climate activist said. (Agencies)

    SRINAGAR MARCH 26:–We cannot allow people to encroach or misuse the public properties ‌Chairperson of Jammu & Kashmir Waqf Board Dr Syed Darakhshan Andrabi today visited Barthana Qamarwari in Srinagar to take stock of the unutilised Waqf land there.

    Dr Andrabi was accompanied by the revenue officials for on the spot demarcation of the land which had remained abandoned for decades which had led to the partial encroachment of the property from a few residents of the locality. Dr Andrabi issued orders on the spot for the retrieval of the encroached part of the land and formulation of a plan for the fencing after the demarcation process is complete. She said that Waqf Board took action on many such abandoned properties of the Waqf which were allowed to be encroached because of the inaction and irresponsible attitudes of earlier Boards. “We cannot allow people to encroach or misuse the properties donated by our ancestors for the collective good. The Board will take suitable action for utilizing this property in the interest of the community at large and ee expect all the local people’s cooperation”, said Dr Darakhshan Andrabi. Later speaking to the media Waqf Board Chairperson said that during the past two years, the Board has successfully retrieved many such assets from the misuse or encroachment throughout J&K with public cooperation and this move will continue in future too. Replying to a question from media Dr Andrabi said that Board was busy in making all preparations for Jumma-tul-Vida Shab-e-Qadr & Eid celebrations throughout Jammu & Kashmir

    Identified as Zaheer Ahmed son of Razaq Khan resident of Kakora Manjakote, he was evading his arrest in Case FIR No 44/2023
    U/Ss 341/323/504/506 IPC and against whom warrant U/S 299 CrPC has been issued by Hon’ble Court on 29/12/2023.

    He was evading his arrest but has been arrested now.

    RAJOURI MARCH 26:–Jammu and Kashmir police in Rajouri has detained a man wanted for implementation of Public Safety Act (PSA) warrant.

    Police said that the detained accused is identified as Tariq Mehmood son of Mohd Kabir resident of Nerojal village of Thanamandi.

    The accused is involved in unlawful acts and his detention was need of hour for public peace and order.

    He was absconding since September 2023 after a warrant under PSA was issued by District Magistrate.

    His detention warrant has been executed and is now being lodged in District Jail Dhangri Rajouri.

    A team of police headed by SHO Thanamandi made the arrest of accused.
