    Jammu Lawyers urge for Strengthening and Retention of Article 35-A, Tinkering with Article 35-A will amount to Constitutional blunder and will create further divide in the State of J&K

    Jammu July 30:-Today Prominent Lawyers of J&K High Court Bar Association, Jammu held an emergent meeting under the Chairmanship of Former Senior Additional Advocate General S.C. Gupta to discuss the prevailing situation in the State of Jammu and Kashmir with special reference to its special status and importance of Article 35-A of Indian Constitution. Various members of Jammu Bar expressed their views for strengthening and retention of Article 35-A of the Indian Constitution.

    Senior Advocate and Former President Bar Association Jammu A.V. Gupta vociferously urged for retention of Special Status of the State and said any tinkering with Article 35-A would have serious repercussions. The former Bar President lamented those elements who are misguiding the masses about the benefits of Article 35-A. He further said that State of Jammu & Kashmir is a backward State with meager resources including employment opportunities and the biggest causality of scrapping of Article-35-A will be the educated unemployed youth of the State. He further urged that J&K is the only State in India which enjoys a Constitutional Guarantee to free Education from Primary to Post Graduation Education and also includes professional education like Engineering and Medical Education.

    K.K. Pangotra Former Assistant Solicitor General of India (ASGI) while expressing his views stated that tinkering with Article 35-A will amount to Constitutional blunder and will create further divide in the State of J&K. Pangotra urged that the matter is sub-judice in the Apex Court and propriety demands that all the parties must await the verdict of the Supreme Court.

    Advocate M.R. Qureshi (Former MLC) highlighted the importance of Article 35-A and strongly urged for its retention in view of the Special Status of the State under Indian Constitution. Qureshi advocated mass awareness so that the permanent residents are informed about the benefits arising out of Article 35-A.

    Former AAG Ahsan Mirza strongly advocated the retention of Article 35-A and presented a historical prospective of the Special Status of the State and urged the Central Government to await the final outcome of the litigation. He also appealed the masses to maintain brotherhood and to defeat the nefarious designs of those who want to create unrest in the Society.

    In his presidential remarks noted lawyer S.C. Gupta appealed the masses to remain united at this crucial juncture and not to be mislead by those who are trying to create wedge amongst different sections of the Society over Article 35-A of Indian Constitution. Sr. AAG Gupta vehemently urged that the issue of accession of the State to India should not be examined in the perspective of religious lines. The retention of the provisions is not a benefit to the majority community in the State. It defines the relationship between State and India. The introduction of such provisions was the outcome of the special conditions prevailing at the time and any decision for their alteration lies with the people of the State and none else.

    Others who were present in the meeting include Advocates Shamas-ud-Din Shaaz, Ahtsham Hussain Bhat, A.A. Khan, M.A. Shah, Yasser Khan and Mohd. Zulkarnain Chowdhary.

    Advocate Sheikh Shakeel Ahmed conducted the proceedings of the meeting.

    اگر آپ اچھا رزق کما رہے ہیں تو یقین جانیں اس میں آپ کی ذہانت یا صلاحیتوں کا کوئی کمال نہیں، بڑے بڑے عقل کے پہاڑ خاک چھان رہے ہیں۔

    اگر آپ کسی بڑی بیماری سے بچے ہوئے ہیں تو اس میں آپ کی خوراک یا حفظانِ صحت کی اختیار کردہ احتیاطی تدابیر کا کوئی دخل نہیں۔ ایسے بہت سے انسانوں سے قبرستان بھرے ہوئے ہیں جو سوائے منرل واٹر کے کوئی پانی نہیں پیتے تھے مگر پھر اچانک انہیں برین ٹیومر، بلڈ کینسر یا ہیپاٹائٹس سی تشخیص ہوئی اور وہ چند دنوں یا لمحوں میں دنیا سے کوچ کر گئے۔

    اگر آپ کے بیوی بچے سرکش نہیں بلکہ آپ کے تابع دار و فرمانبردار ہیں، خاندان میں بیٹے بیٹیاں مہذب، باحیا و با کردار سمجھے جاتے ہیں، تو اس کا سب کریڈٹ بھی آپ کی تربیت کو نہیں جاتا کیوں کہ بیٹا تو نبی کا بھی بگڑ سکتا ہے اور بیوی تو پیغمبر کی بھی نافرمان ہو سکتی ہے۔

    اگر آپ کی کبھی جیب نہیں کٹی، کبھی موبائل نہیں چھنا تو اس کا یہ مطلب نہیں کہ آپ بہت چوکنّے اور ہوشیار ہیں، بلکہ اس سے یہ ثابت ہوا کہ اللہ نے بدقماشوں، جیب کتروں اور رہزنوں کو آپ کے قریب نہیں پھٹکنے دیا تاکہ آپ ان کی ضرر رسانیوں سے بچے رہیں۔

    الحمدللّٰہ مجھے مذکورہ بالا تمام نعمتیں میسر ہیں سوائے اس کے کہ ایک بار حیدرآباد میں ایک تھکا ہوا نوکیا موبائل جیب سے نکل گیا وہ بھی اس لیے کہ میرے ایک عزیز کا موبائل نکل جانے پر میرے دل میں یہ خیال آیا کہ لوگ کیسے مست و مدھوش ہو کر چلتے ہیں کہ کوئی ان کی جیب سے موبائل لے اڑے، انہیں پتہ تک نہیں چلتا۔ بس اگلے ہی دن میرے ساتھ بھی ایسا ہی ہوگیا۔ من میں جھانکا تو اندر سے صدا آئی: اے ڈیڑھ ہوشیار! جب تقدیر کا لکھا سامنے آ جائے تو عقل کی چڑیا پرواز کر جایا کرتی ہے۔

    دبئی میں ایک صاحب سے واسطہ پڑا۔ پہلے مجبور و پریشان تھے، پھر کنسٹرکشن کی کمپنی کھول لی۔ پر شکوہ آفس بنایا، سمجھیں کہ لاکھوں میں کھیلنے لگے۔ ملاقات کے لیے گیا تو ایک مشترک دوست کے بارے میں پوچھا، جو بیچارے مفلوک الحال رہا کرتے تھے۔ پھر کہنے لگے، وہ تو بڑے کم عقل انسان ہیں، ساری زندگی یوں ہی عسرت میں گزار دی۔ یہ کام کر لیتے وہ کام کر لیتے، وغیرہ وغیرہ۔

    کوئی دس بارہ سال کا وقفہ آگیا، ہماری ملاقات نہ ہوئی۔ پھر ایک دن کسی کام سے ان کے آفس جانا ہوا۔ خود نہیں تھے بلکہ پورا اسٹاف ہی بدلا نظر آیا۔ میں نے موصوف کا نام لے کر پوچھا کہ کہاں گئے، پہلے تو یہ ان کا آفس تھا؟ بتایا گیا، مرحوم ہو چکے۔ پھر تفصیل بتائی جو کچھ یوں تھی کہ کاروبار میں نقصان ہونے کی وجہ سے پیچھے ہوتے چلے گئے پھر مقروض اور نادہندہ بن کر جیل پنہچ گئے۔ چیک باؤنس کیس میں سزا ہوئی اور اُسی سزا کے دوران جیل ہی میں انتقال کر گئے، اس حال میں کہ فیملی پاکستان میں تھی، نہ کوئی عزیز قریب تھا نہ کوئی فیملی ممبر۔

    یہ خبر سنتے ہی میرے سامنے دس سال قبل کا اسی کمرے کا منظر گھوم گیا جہاں گول گھومتی کرسی پر بیٹھ کر مرحوم ایک سادا اور خدا مست درویش کی مالی ابتری کا مذاق اڑا رہے تھے۔ بادشاہ کو فقیر بنتے دیر نہیں لگتی، سن رکھا تھا مگر بچشمِ خود دیکھا اس دن تھا۔

    اگر کوئی چاہتا ہے کہ اسے رزق کے معاملہ میں آزمایا نہ جائے تو تین کام کرے:

    اوّل: جو کچھ مل رہا ہے اسے محض مالک کی عطا سمجھے نہ کہ اپنی قابلیت کا نتیجہ اور ساتھ ہی مالک کا شکر بھی بجا لاتا رہے۔

    دوئم: جن کو کم یا نپا تلا رزق مل رہا ہے انہیں حقیر نہ جانے نہ ان لوگوں سے حسدکرے جن کو “چھپر پھاڑ” رزق میسر ہے۔ یہ سب رزّاق کی اپنی تقسیم ہے۔ اس کے بھید وہی جانے۔

    سوئم: جتنا ہو سکے اپنے رزق میں دوسروں کو شامل کرے۔ زیادہ ہے تو زیادہ، کم ہے تو کم شامل کرے۔ سب سے زیادہ حق، والدین اور رحم کے رشتوں کا ہے۔ نانا نانی، دادا دادی، بہنیں اور بھائی ہیں۔ اس کے بعد خون کے دوسرے رشتے ہیں جیسے خالہ، پھوپھی، چچا، ماموں، چچی وغیرہ۔ پھر دوسرے قریبی رشتہ دار یا مسکین و لاچار لوگ۔ یقین رکھیں کہ جب بہت سے دعا کے ہاتھ اس کے حق میں اٹھیں گے تو برکت موصلہ دھار بارش کی مانند برسے گی جس کی ٹھنڈی پھوار اس کی زندگی کو گلشن گلشن بنا دے گی۔

    Rajouri July 30: In order to approve the rent cases of the buildings occupied by the government departments, the District Development Commissioner Rajouri Mohammad Aijaz Asad today chaired a meeting with the concerned officers and owners of the private buildings here in the Conference Hall of DDC office.

    During the meeting, the DDC, who is also chairman of the Rent Assessment Committee, held a detailed discussion with departments concerned which are functioning from rented accommodations in the district and with the owners of these buildings.

    After detailed deliberations, the Committee approved 25 rent assessment cases. As many as 29 cases of assessment were presented before the committee.After a detailed discussion, the committee approved 25 cases out of 29, 02 cases were referred to the departments for reassessment and 02 cases were deferred.The DDC directed the officers concerned to expedite payment of rents as per the rates approved in the meeting.

    The meeting was attended by Assistant Commissioner Revenues,Mohd Ashraf,Chief Medical officer Dr.sunil Sharma,EXN PWD Zubair Ahmed, Assistant Director Food supply, Mukhtar Ahmed lone,District Social Welfare officer,Mohd Naseeb, Accounts Officer,DC office,Talat Khan and owners of private buildings.

    Teaching fraternity consisted of teachers, masters and lecturer is the largest human force strength after police department in the state. It has been observed that normal tranfer and posting process has not been set on track since 2014 for one or the other reasons. The process has been facing a killing halt since Model Code Conduct of 2014 parliament elections. After the parliament elections were over adminstration failed to start the process untill educational mid session reached during which transfers are normly avoided for the sake smooth class work. It only saw another MCC for 2015 Assembly election for another two three months next joined by another mid session restrictions unto 2016. Educational session of 2016-17 again could not saw the system resumed due to frequently swipe of ministries and portfolios and various other reasons. The mid session was followed by the collapes of the coalation govt causing choas and further stagnation to the process. It just followed by anther spiral circle of MCCs for panchayet elections, parliament elections and mid sessions. Teaching employees working in hard zones are facing multiple consiquencies regarding their domestic life as well as profassional career, told an annoyed lecturer waiting for more than 10 years for tranfer from hard zone as per policy.
    Many teachers expressed their egony over the faluir of transfer policies framed from time to time on papers but never implemented.

    We are extremely distrusted and disgusted to see another ban on the transfer process for two more months, for no reasonn, by the wothy adviser F A Khan at such a crucial stage where another mid session is approaching and another MCC is waiting next for another Assembly elction, told annoyed teachers working in hard zones since several years.


    Teaching fraternity has appealed to the Governor office and observer Farooq Khan to resume the transfer process as the proposals are mostly prepared in DSEs and CEO offices to relieve the teacher of mental and psycological tourcher.

    Udhampur July 30:-Continuing *JKP’s #WarOnDrugs* offensive to contain the spread of narcotic drugs & psychotropic substances, Udhampur police today recovered *10grms* of contraband substance(“`chitta“) near Radha Swami Satsang Bhawan, Ramnagar, Udhampur.

    Giving details Rajiv Pandey, IPS SSP Udhampur* Based on some reliable information regarding smuggling of heroine (chitta) like substance, Police party of PS Ramnagar led by SI Jaswinder Singh SHO PS Ramnagar under the supervision of Jagdev Singh Slathia SDPO Ramnagar and Rajinder Kumar Katoch Addl. SP Udhampur laid a naka near Radha Swami Satsang Bhawan Ramnagar, Udhampur for checking of vehicles.During naka checking, police party of PS Ramnagar caught one suspected person who tried to hide himself from the police party.The suspected persons was taken into custody and during his personel search, 10 grms of heroine like substance was recovered from narcotic smuggler namely *Krishan lal @Lundi S/O Badri Nath R/O W. No. 09, Ramnagar* was arrested on the spot and recovered heroine like substance was also seized.

    In this connection, a Case FIR no. 81/2019 u/s 8/21/22 NDPS Act stands registered at PS Ramnagar and further investigation of the case is taken up
