  • State Jammu and Kashmir Delimitation issue

State Jammu and Kashmir Delimitation issue

During President rule the legislative authority is vested to governor. The last delimitation on provisional basis was done in 1993 by the then Governor Jagmohan when j&k was divided into 87 assembly constituency but that time 84th ammendment was not in force ,this has came into effect in 2001 by Vajpayee Government ratified by Faroq Abdullah government in the state.

The governor is competent to amend sec 47 of the constitution to delete the objectionable proviso which barred the setting up of a delimitation commission but in recent condition Governor cannot overlook Constitutional ammendment
Governor can mandate to constitute a delimitation commission only during normal conditions.

As the Government at centre has thumping majority so it must first amend the amendment freezing delimitation till 2026 …
J&k has the power to revoke the law through a constitutional amendment with two third majority and ramp up the numbers of seats.Without popular Government doing such is non conventional and can upbring resentments and criticism.
