    Jaitley’s assertions on Article 35A un-factual: Tarigami

    Jammu, Mar 29 (KNS): CPI (M) leader Mohammad Yousuf Tarigami Friday said that the statement of Union Finance Minister and the BJP leader Arun Jaitley that Article 35A is “constitutionally vulnerable and is an impediment to the economic development of Jammu and Kashmir” reveals the real intentions of the Saffron party vis-à-vis special status of the state. “They (BJP) are misrepresenting the constitution and the state,” he said.

    In a statement issued to KNS, Tarigami said, “Why don’t BJP leaders come open and say whatever laws were passed by the then ruler of the state Maharaja Hari Singh were wrong? State subject law was passed by the Maharaja in 1927 and it was incorporated in the Constitution through negotiations and carried forward. Is there anything new which the BJP wants to scrap?”

    “The Maharaja acceded to India by signing the instrument of accession and surrendered only three subjects i.e external affairs, defense and communication to the dominion of India while on all other subjects, the ruler of the state continued his sovereignty in and over the state by virtue of para(8) of the Instrument of accession,” Tarigami added.

    He said, “As such, Article 35-A flows inevitably from Article 370 of the Indian Constitution. The Constitution of Jammu and Kashmir enacted in 1956 has also put its seal on the relevant notification vide Clause 13. Those who challenge Article 35-A, conveniently forget that it was only Article 1 and Article 370 which were applicable to J&K at the time (1954), the Presidential order regarding addition of Article 35-A was made. As such, the Article 368 could not have been resorted to, for the addition of Article 35-A.”

    “If the Article 35-A is deleted from the Constitution, the accession of the state with the Union of India is liable to be jeopardised. Article 35-A is not the only provision in the Constitution of India in its application to the State of Jammu and Kashmir, which has been added by the President by a Presidential Order issued under Article 370 (1),” CPI (M) leader said.

    He said, “At this juncture all the broad minded and democratic forces including political parties, intelligentsia and the civil society at large, should put their heads together, discuss the situation intensively and launch a concerted struggle against this mischief. While doing so caution has to be exercised so that the forces who profess hyper nationalism for political interests should not divide people of the state on regional and communal lines.”

    “The conspiracy to remove Article 35-A is essentially the agenda of communal, divisive and anti-democratic forces who want to thrive on uncertainty, discard, hatred and turmoil. It remains on their agenda and is being exploited for political and electoral gains,” Tarigami said. (KNS)

    Eleven drivers booked for overloading in Rajouri, FIRs registered

    Rajouri ,March 29:–Rajouri police booked and arrested eleven drivers for indulging in over loading of passengers in their passenger vehicles thereby resorting to grave violation of norms which can lead to fatal road accidents.

    A team of police headed by SDPO Manjakote, Nisar Khoja was on patrolling at Manjakote when a tata sumo JK12A 0658 was found overloaded after which driver was arrested on the spot and a case FIR 20/2019 has been registered in Manjakote police station under sections 279, 336 RPCs.

    Team of police headed by SHO Rajouri Ajaz Haider was on patrolling at Mandi- Kheora road of Rajouri town when two passenger auto rikshaws bearing registration numbers JK11A 4271 and JK11 4122 were found plying overloaded with passengers even hanging from the doors.

    Both the vehicles were seized on the spot and cases FIR 152/2019 and 153/2019 under sections 279, 336 RPCs have been registered in police station Rajouri.

    A team of police from Kalakote police station headed by SHO Tahir Khan was on traffic checking when a minibus JK11 1209 driven by Inder Jeet Raina son of Kuldeep Raina resident of Dharamsal and tempo JK11 4751 driven by Rohit Singh son of Surjeet Singh resident of Sialsui were intercepted and were found overloaded with passengers.

    Both the vehicles were seized on the spot and cases in FIR 22/2019 U/Ss 279, 336 RPC and FIR 23/2019 U/Ss 279, 336 RPC have been registered in Kalakote police station.

    Team of Thanamandi police also registered cases in FIR 21/2019 and 22/2019 under sections 279, 336 RPC against drivers of vehicles minibus JK02H 3429 and sumo JK11A 5079 respectively.

    Both the vehicles were found heavily over loaded during inspection by team headed by SHO Javed Malik.

    Team from Sunderbani police station headed by SHO Sunderbani Naveen Angral also intercepted an overloaded minibus JK14A 3045 which was on way to Sunderbani from Seri.

    Vehicle was found overloaded with passengers after which a case FIR 25/2019 under sections 279, 336 RPC has been registered against the driver of the vehicle.

    A team of police from Nowshera police station headed by SHO Mohammad Amin Malik and intercepted a tata magic auto JK11B 8030 which was found overloaded with eleven passengers after which a case FIR 53/2019 under sections 279,336 RPC has been registered in Nowshera police station.

    Team of police headed by SHO Dharal Barket Qureshi also intercepted a tempo traveller JK02AN 7775 on Darhal road which was found overloaded and driver was also driving the vehicle rashly. Taking note a case FIR 14/2019 under sections 279, 336 RPC has been registered in Darhal police station.

    Similarly, a team of police headed by Incharge Police Post Chingus Chatyar, SI MD Khan also raised a traffic checking naka on Rajouri – Doongi road and intercepted
    a minibus JK02H 1499 which was heavily overloaded.

    In this connection FIR No 154/19 under sections 279/336 RPC has registered in police station Rajouri.

    On 09 Jan 2019 , Dr Shah Faesal , top IAS officer of Jammu and Kashmir who was heading Jammu and Kashmir Power Development Corporation since from last year announced unanimously his resignation through social media networking sites that was carried by National and international media in different editions. It is matter of concern that Why a top IAS Officer resign ? Who has tops IAS Cadre in 2010 as Ist position holder from Jammu and Kashmir .
    Although Shah Faesal himself have expressed his reason behind his resignation but that is secondary issue which he had expressed because the fact is that the dirty politics have forced him to resign . In our India , everyone who fails in every sector and is not having any other option join politics or media as both have became den of irresponsibilities . In these days that everyone looses his trust upon media and politicians as both are sailing in same boat .
    Expressing my personal views upon Shah Faesal resignation as I have asked same question from various of my colleagues but all replies in different ways as per their views . What I imagine is fact or not , that knows only one who leaves his top rank in India .
    Shah Faesal top IAS Officer is resident of Kashmir valley and his expression on resignation is not so fact as so he announced . The fact is that , Shah Faesal holding various cadres in state with his honestly and dedication is an example for all other officers . He resigned only due to dirty influence of dirty politicians and parties who forces an employee to do wrong by sitting on this prestigious chair .
    A friend while expressing his personal views on resignation , said that once I along with delegation went to Civil Secretariat and were accompanied with a mass political leader who was in government. As soon we enters in cabin of top IAS Officer , the political leader started abusing him and forced upon him to do same with in no time as the leader was part of government .
    Though the work was on public interest but the behaviour of such leader couldn’t be beared by anyone despite someone who had tops civil services exam .
    In such a case various times these issues happens in offices that is not good for society and resignation of Shah Faesal may be such same cause that he doesn’t want to present in public domain.
    Scores of activists expressed their views on resignation of Shah Faesal and wrote different columns and expressed their views but a column written by renowned Socio Political Activist Junaid Malik titled “Shah Faesal ,The monk who sold his Safari”, was too much different and unique rather than all .
    It is matter of fact that Shah Faesal had himself imagined that I am IAS and had topped UPSC exam with top rank as first aspirant of Jammu and Kashmir but such a political leader who is simply 10th or 12th or even more than 12th is having such a valve and respect that becames a lawmaker upon IAS officer whose half of life goes in preparation and studying IAS .
    The main reason behind his resignation is corruption and dirty politics as in his every public address , He talked about transparency and free environment for all and asked youth to join mass movement to struck off the corrupt mafia from society .
    The setting up his own political parties is only platform for every section of society who had became prey and victim of dirty politics . On launching ceremony Shah Faesal said I have been pushed by youths of state to launch own political party soas everyone’s voice could be heard . I agreed with all youths who was to bring change and is changing the wind of current political scenario by setting all abide and are joining “ JAMMU AND KASHMIR PEOPLES MOVEMENT ” the last hope of youngsters .
    In short Shah Faesal is visionary and vast minded personality whose decision of resignation couldn’t be challenged but living in such victimized region had experienced me about such facts .

    Rajouri,March 29 2019:–Construction of road at chapriyan new extension colony to house of Rashid lone have been tendered by PWD Rajouri the foundation stone of the said road was laid by Local MLC.

    It is pertinent to mention here that the work of the said road was already taken up by Rural Development Department by engaging contractor who taken up under CM commitment and under scheme BADP Tribals in session 2017/18.
    The contractor has already spent lacs of rupees on the said work and the liability is still pending .
    Strange part is if PWD will take up the work than lacs of ruppess spent by contractors through Rural Development Department will go waste.
    Public works department to keep their political bosses happy tendered the above mentioned work with sole motive of favouritism their by causing huge losses to the state Exchequer.
    People of the said area have requested to  Governor of J&K , advisors and other concerned officials to interven and save the public money going waster which will cause huge loss to the state Exchequer and stop the openly violence of works rules and regulations act.

    Interestingly the same link road work started by contractor few days a go with the direction of PWD Rajouri with out any hand over take over the road from existing agency RDD Rajouri which hv huge liability in the same road. It is matter of violation of rules and norms of Public Works and Road and Building Act.1983.
    It is Cristal clear that PWD Rajouri and district Administration Rajouri working look like under the pressure and guidelines of some BJP leaders and openly violates all norms of PWD R&B Act 1983 and such department are going to implementation all agenda’s of RSS and BJP coming from their Nagpur Headquarter when models codes of conduct announced and implemented all over the country by the strict order passed by Election Commission of India.
    In this regard the contractors has decided to knock the door of Hon’ble High court Jammu and Kashmir for Justice as soon as possible.
